Terms of Service

GENERAL

• I will charge more depending on complexity of the request; I am open to negotiations with regards to this. • I reserve the right to decline any commission if I do not feel comfortable doing it. • I will not complete NSFW commissions for minors. Any minor who tries to get around this or lie about their age will be blacklisted.

PAYMENTS

For any and all commissions less than $100, payment will be accepted up front. For custom commissions with more communication required or a higher pricetag, I will accept 50% up front and 50% upon completion of commission. The full files will not be sent until 100% of payment is received.

REVISIONS

• Revisions for foundational things such as pose, background, concept can be changed upon the completion of the sketch. After the sketch is approved, no changes can be made to it once the inking/rendering phase begins. • After coloring is completed, there will be another phase for revisions where you can ask for adjustments to lighting and color. No foundational revisions can be made at this time. Once the final product is approved, no more edits can be made and once payment is received, the final deliverable will be received.

DEADLINES AND DELIVERY

• Typically ~ 2 mo turnaround time (non-nugget). • Rush charges may apply if deadline is too close to commission date. • If there is ever a time I may need to take longer, I will keep you updated on things that may cause it to take longer, alongside with any WIPs I have.

USE

• Unless otherwise discussed, my commissions are personal use only. They can be used for profile pictures/banners, but not for advertisement or use in products. • Only after negotiations and fees will proper commercial fees be discussed. • My art under no circumstances may be used in the production, promotion, or selling of NFTs (non-fungible tokens). • My art under no circumstances may be used to train an AI.

INTELLECTUAL PROPERTY RIGHTS

• I retain all intellectual property to my illustrations. If it is for commercial use, unless there is an NDA, I can use the artwork for portfolio purposes. Once the NDA date has passed, I can post the images I created for my portfolio. The purchase of the Intellectual Property can be negotiated for additional fees. • My art under no circumstances may be used in the production, promotion, or selling of NFTs (non-fungible tokens), commissioned or not. • My art under no circumstances may be used to train a Generative AI, commissioned or not.

REFUNDS

If the commission has not been started within the 2 month turnaround time, you may request a full refund on the commission. If your commission has been started, you may ask for a partial refund.

COMMUNICATION

I will communicate with my USD clients primarily through VGen to keep things organized, however, if your preference is sMail please denote that in the Vgen form. Please keep any and all correspondence within VGen or Email if that is preferred to ensure nothing gets lost. For "Surprise Me" commissions, I will communicate when I begin the commission and send the final deliverable after payment is received.
