If you committed lots and lots of murders and you were a serial killer, and everyone was looking for you and you had like... a ninety bajillion dollar bounty on your head and you confessed the murders before they administered your Miranda Rights, could they hold what you said against you in the court of law?

I mean, If you were like, "I killed everyone!" And then they were like, "Anything you say can and will be used against you in the court of law,"

They technically can't use it against you, right? Because you weren't aware. Right?

Anyway, mindless thinking. I've been watching to many police dramas.

... huh? You pretty much mean, that if you confessed to the murders, without having the knowledge of the police wanting your head, they couldn't use it against you? Or did I read that wrong?

this is my face when i was reading this: :| i have no idea what you mean, are you saying that if you confess to a crime before they read you your rights, you...technically didn't confess because they weren't interragating you...yet?

This made me lol. I am pretty sure it would be admissible though, regardless. It isn't like the confession was obtained illegally or anything. If you were that stupid to kill tons of people and you just blab to the cops prior to being interrogated then you really should just get express ticket to the chair to get your genes out ASAP. :/

They have to Mirandize you the second they arrest you. If they aren't interviewing you and you aren't under arrest, and you confess, they can use it in court. If they're officially talking to you, they have to read your rights, but if you just see them and scream out "I DID IT"...you're screwed. :P

wow um. ur kinda confessing so they can use it against you in a court of law. besides theyd give you the death penalty and ship you off to jail anyway

Kinda reminds me of something that happened a few years ago, when I was in the 6th grade, I wrote a paper about the Columbine shooting. The counselors brought me into their office and started accusing me of being a terrorist or something. Long story, but I sat there with my arms crossed and refused to be questioned until I had my parents present or a lawyer.

Yeah, you have the right to a lawyer when your counselors are questioning you. They were shocked I knew that in the 6th grade.

Anyway, they finally called up my parents because I reminded them it was in the student rights /and/ the bill of rights. They were like: O: No it's not you idiot!

Me: Yes it is and I am not speaking until then.

So yeah. They hated me afterwords. xD

I think they just wanted something big and surprising to happen at our stupid school.
