if i use the EHW on a pet; does the name become free instantly?

I never knew that steamwork pets get gears for their gender, so i might make the name of one of my pets free, then make a steam works pet.

So is it instant? or is there a waiting period?

It becomes free just after you change it. I swapped two of my pets' names recently.

If you use an EHW, the pet name that got replaced clears instantly.

Just as a heads-up if you want the gear gender for your Steamwork pet, I'm pretty sure it only applies to Steamwork pets created from scratch, and if you were to just convert one of your existing pets to Steamwork they would keep their old gender.
